1. Introduction

These Terms of Use ("Terms") govern access and use of the website https://thumbpro.com.br and services offered through our platform, including the sale of credit packages for artificial intelligence image generation ("Service"). By using our Service, you fully agree to these Terms.
2. Terms Acceptance
By accessing or using the Service, the user declares to agree with these Terms and our Privacy Policy, committing to comply with them. If you do not agree, do not use our services.
3. Definitions
- User: Individual or legal entity that uses the Service.
- Image Credits: Digital monetary unit acquired for image generation through the Service. These credits are consumed as images are generated and are eligible for refund, according to the refund policy described in this document.
- Search Credits: Digital monetary unit acquired for using search functionalities and other queries on the platform. These credits are non-refundable.
- Credit Package: Set of credits offered to the user upon payment. The package value is calculated based exclusively on the amount of Image Credits.
- Refund: Return of the proportional value referring to unused Image Credits, calculated according to the unit value of each credit.
- Service: SaaS platform that allows image generation through artificial intelligence by consuming credits.
4. Contract Object
This contract aims to regulate the provision of the Service, platform access and the sale of credit packages, as well as the refund policy applicable to unused Image Credits.
5. Registration and Account
To use the Service, the user must register providing true and updated information. The user is responsible for maintaining the confidentiality of their credentials and for all activities performed on their account.
6. Credit Sales and Payments
6.1 Credit Acquisition: Packages may include two types of credits: Image Credits and Search Credits. The package price is calculated based exclusively on Image Credits, whose unit value is defined by the following formula:
Image Credit Value = Total Package Value / Number of Image Credits
6.2 Payment Methods: Payments will be processed through the means available on the platform, subject to their analysis and approval.
Note: Search Credits do not influence the package value and are not eligible for refund.
7. Refund Policy
7.1 Right to Refund: If the user wishes to request a refund, it will be processed only for unused Image Credits, calculated by multiplying the number of unused Image Credits by the unit value, as defined in Section 6.1. The refund will be valid only for credits acquired in the last 30 (thirty) days, counted from the date of the last purchase registered in the user's account.
7.2 Refund Procedure: The user must contact our support through email [email protected] or other official channel, providing purchase details and the number of unused Image Credits. The refund will be processed using the same payment method as the purchase, unless otherwise agreed.
7.3 Conditions and Exceptions: If Image Credits have already been partially consumed or if the Service has been used significantly, the refund may be denied or the refunded amount will be proportionally reduced.
7.4 Search Credits: Search Credits are expressly considered non-refundable, regardless of use.
8. Service Usage
8.1 User Responsibilities: The user commits to use the Service lawfully and in accordance with these Terms, not engaging in practices that may harm the platform's operation or cause damage to third parties.
8.2 Interruption or Suspension: ThumbPro reserves the right to suspend or interrupt the Service, totally or partially, for technical reasons, maintenance, or in case of violation of these Terms.
9. Intellectual Property
All content, logos, images and trademarks of ThumbPro are the exclusive property of the company or its licensors. Unauthorized use of these materials may violate copyright and other laws.
10. Limitation of Liability
ThumbPro is not responsible for direct, indirect, incidental, special or consequential damages arising from the use or inability to use the Service, including problems arising from payment processing, refunds or platform access.
11. Terms Modifications
ThumbPro reserves the right to modify these Terms at any time, publishing the updated version on the website. Continued use of the Service after changes will imply acceptance of the revised Terms.
12. Validity and Termination
These Terms come into effect on the date of their publication and will remain valid while the user uses the Service. ThumbPro may terminate access for users who violate these Terms, without prejudice to applicable legal measures.
13. General Provisions
All communications between the user and ThumbPro will be conducted through official channels, such as email and support. ThumbPro is not responsible for delays or failures arising from events beyond its control (force majeure).
14. Applicable Law and Jurisdiction
These Terms are governed by Brazilian laws. The jurisdiction of Belo Horizonte, State of Minas Gerais, is elected to resolve any disputes arising from these Terms, with waiver of any other jurisdiction.
